Indiana’s law about abortion, Indiana Code § 16-34, provides a near total ban on abortions except in very limited circumstances and time frames. While some states may allow a woman to have an abortion up to a certain number of weeks into the pregnancy for any reason or just because she wants to abort the fetus, Indiana does not. Therefore, if you do not fit into one of the exceptions found in Indiana Code § 16-34, you will need to look into other options for your baby. Indiana Code § 16-34-2-1 permits a woman to abort a baby during the first 10 weeks of her pregnancy if she got pregnant as a result of rape or incest. While Indiana’s new abortion law does not require a conviction or even a reporting of the rape or incest by the pregnant woman, Indiana Code § 16-18-2-306.7 expands the definition of “rape or incest” to include a child conceived as a result of child molesting (IC § 35-42-4-3), child seduction (IC § 35-42-4-7), and sexual misconduct with a minor (IC § 35-42-4-9).

However, other provisions of Indiana Law such as IC §§ 31-32-11-1 and 31-33-5-1 may impose on the doctor the obligation to report to the department of child services or local law enforcement agency suspected child abuse or neglect. Incest, child molestation, child seduction, and sexual misconduct with a minor may fall into the category of reportable offenses. 

Additionally, IC § 16-34-2-1 (a)(2)(D) requires the doctor to certify in writing to the surgical center or hospital all facts and reasons supporting the physician’s certification, which presumably includes facts about the rape or incest. 

Finally, a doctor who performs an abortion without complying with IC § 16-34-2-1 commits a criminal act, which could subject the doctor to criminal and civil penalties and forfeiture of their license to practice medicine. The reporting requirements imposed on the physician under § 16-34-2-5 seem designed to substantiate how abortion fits within the exceptions of the total abortion ban imposed by Indiana law.

With the Supreme Court overturning Roe vs. Wade, some states, like Tennessee and Mississippi, may significantly reduce, if not eliminate, access to abortion as a way of family planning. In those states, a woman facing an untimely pregnancy or unplanned pregnancy, who does not have the support of friends and family and knows that she cannot commit to the lifetime responsibility of parenting a child may find putting the baby up for adoption or, more correctly, making an adoption plan for her unborn baby provides a good, if not better, alternative to aborting the baby. “Better” in the sense that few people can say that they CHANGED THE LIVES OF ANOTHER PERSON in any significant way. Giving a family a baby that cannot get pregnant is the most amazing gift one person can give another. It is as close to “God-Like” as any other human endeavor. In general, adoption professionals avoid expressing an opinion about abortion or Roe v. Wade because banning or limiting abortion seems self-serving in that it would obviously make more babies available for adoption. In this Blog, we at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”) are not advocating for the overturning of Roe v. Wade by the United States Supreme Court but simply stating statistical facts. The Center for Disease Control (CDC) reported that approximately 625,000 women have abortions each year. According to the National Council for Adoption Factbook, there were just over 18,000 unrelated, domestic adoptions of newborns a year.  If 10% of those women who had abortions gave their babies up for adoption, or more correctly, made adoption plans for their babies, the number of unrelated domestic adoptions would have INCREASED by 62,500 per year – 350%.

If the United States Supreme Court determines that the United States Constitution does not include the right to have an abortion, some states will impose substantial restrictions or limitations on the availability of abortion. In those states, the number of babies available for adoption will increase. However, it is NOT the obligation of pregnant women considering abortion to put up their babies for adoption. A woman facing an unplanned or untimely pregnancy undoubtedly faces the most difficult, gut-wrenching decision one could imagine. Ultimately, she will have to determine what is in her best interests. A woman, who believes that life begins at conception, will also take into consideration the best interests of her unborn child.

They are the same in some ways but VERY different in what is, perhaps, the most important way.

The similarities include:

  1. Both are very personal decisions.
  2. Both are readily available and legal, in most places.
  3. The birth parents do not have the responsibility for raising the child.
  4. Neither changes the fact that the expectant mother conceived a child and is pregnant.
  5. Both are unforgettable experiences.
  6. They cannot be “undone.”
  7. No matter what decision you make — some will agree with you and some will criticize you.

The differences include:

  1. In an adoption, the birth mother carries the baby for nine months and then leaves the hospital without the baby, while an abortion immediately terminates the pregnancy.
  2. Few people understand how a woman can “give away her baby” through adoption, yet at the same time, nearly ½ of the people living in the United States STRONGLY believe that abortion is “okay.”
  3. Abortion does not give the child an opportunity to live life nor fulfill his or her or his destiny.
  4. Adoption demonstrates a birth mother’s (parent’s) sacrificial love for her/their child by putting the child’s life ahead of her/their own desires, needs, and wants.
  5. In adoption, the child lives.

Over the 35+ years we have been handling adoptions, we at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”) have worked with quite a few birth mothers who gave their babies up for adoption or, more correctly, made an adoption plan for their newborns, and later returned to us with another unplanned pregnancy – in fact, two this past weekend!  A previous birth mother said that she felt embarrassed to call us the second time because she felt like “scum” (her words) for winding up unexpectedly pregnant again. We assured her that her situation happens more than she thought – and it does.

Firstly, WE THANKED THE BIRTH MOM FOR CONTACTING US, AGAIN. We told her that even though she did not intend to get pregnant, her pregnancy is certainly not a “mistake”, and that if she proceeded with an adoption plan for her baby, her child will receive a loving, forever family, who wants desperately to have a child.

Most often, when this happens, we ask the birth mother if she would like to have the family, who adopted the previous baby, adopt the soon-to-be-born baby. Almost always she says, “YES,” and the family is thrilled to have the opportunity. As part of our adoption program, we have the adoptive parents provide letters and photos to the birth mother of their child, keeping the birth parent updated on how the child is doing, if the birth parent would like them. We have found a direct correlation between adoptive parents who diligently and timely provide those updates and a “repeat” birth mom’s decision to have the same family adopt.

A month ago, we forwarded to a now thirty-something year-old adoptee a letter his birth mother recently wrote. In his birth mother’s words:

“Over the years you were growing up, I asked on a number of occasions for updates about you. Your parents were kind and generous enough to respond. For that, they have my eternal gratitude. They wrote detailed and thoughtful letters responding to my many questions, describing who you were as a person, experiences you were having, how much they loved you.”

She placed only one child, but we expect that if she had a second untimely or unplanned pregnancy, she would have wanted the original family to adopt.

Very few women with whom we have met over the years got pregnant on purpose; however, the children born as a result of those pregnancies and then adopted have been an absolute blessing to the families who received them. We know this because every year, we receive hundreds of cards and letters from these families telling me how very much these children are loved and adored.

Birth mothers have always been, and will continue to be, heroes in our eyes. They place the needs of their children over their own, and at the same time make the dreams of families who long to be parents come true. It makes no difference whether it is a woman’s first or fifth pregnancy– the utterly selfless act of placing a child for adoption remains the same.
