Effective September 15, 2022, Indiana Code 16-34-2-1, will ban abortion in Indiana, except during the first 20 weeks of pregnancy to prevent “any serious health risk to the pregnant woman or save the pregnant woman’s life” or if “the fetus is diagnosed with a lethal fetal anomaly.” Also, a woman who got pregnant as a result of rape or incest may have an abortion during first 10 weeks of the pregnancy. Additionally, Indiana’s new abortion law limits the use of the abortion inducing drug, Mifepristone, to the first 8 weeks of the pregnancy. Some have described Indiana’s abortion law as the most restrictive abortion law in the country and the first since the Dobbs decision, which overturned Roe vs. Wade.

Let’s start with two obvious facts: (1) You cannot undo the fact that you ARE pregnant, and (2) you will give birth to a baby. None of us can change the past. What has happened has already happened — as the expression goes, “You can’t unring the bell.” You need to change your focus to how to make the best of what you consider a bad situation, if you are not happy about being pregnant. Most importantly, you are now responsible for the life of an innocent child, and you need to make the best decision for him or her. 

For most women facing an untimely pregnancy or unplanned pregnancy, they intentionally or unintentionally (by not making other plans) decide to parent the child. In most situations that decision works out well for the mother and child. For those successfully parenting women, who did not plan to get pregnant, they take on the challenge of parenting a child for the rest of their lives and do it well. 

However, not everyone has the desire, skill, and resources to dedicate their lives to the responsibility of raising a child. For those women, they need to look for other alternatives. Some will find that their parents will happily, or out of a sense of obligation to a grandchild, take on the responsibility parenting the child. 

Another alternative, which does not get nearly enough attention, is to put the baby up for adoption, or, more correctly, to make an adoption plan for the child. Nothing will change the fact of the pregnancy, but giving newborn the gift of a loving, secure, happy home and adoptive parents, desperate for a child, the gift of parenthood may just be the best way to turn a bad, even hopeless, situation into the best outcome for all involved, including the birth mother. Not often can any of us change the lives of others in a meaningful way. To give a child the opportunity for a productive happy life and adoptive parents a child to nurture and love is a close to God-like as anything one human can do for another.

Recently, a birth mother contacted us at Loving Adoptions by Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”) through www.LovingAdoptions.com, and asked us that question. We responded:

“Thank you for your inquiry. Unfortunately, we are probably not your best adoption. We do not do temporary adoptions. However, we do open adoptions in which the adoptive parents would provide you letters and photos for 18 years letting you know how the child is getting along. Some of our clients may be open to a limited amount of visitation during the first few years, but in any adoption, we handle, the adoption would terminate your parental rights and make the adoptive parents the legal parents of your child. If you decide to work with us, you could choose the adoptive parents from a carefully screened and fully investigated group of prospective adoptive parents. You could talk with them by telephone and meet them in person if you wish. If you decide that an adoption like the one, I described is best the way to assure that your child receives the life and future you want for your child, please let us know. I wish you well.”

Yes, Indiana Code § 31-19-7-1(a) states: “A child may not be placed in a proposed adoptive home without the prior written approval of a licensed child placing agency or the local office approved for that purpose by the department.” Pre-adoptive approval includes a criminal check, as set forth in Indiana Code § 31-9-2-22.5, of all persons, at least eighteen years old, living in the proposed adoptive home. Indiana Code § 31-19-7-1(b). Additionally, the attorney filing the petition for adoption must file the prior written approval with the petition for adoption, as required by Indiana Code § 31-19-7-7-3. Of note, this statute does not require the filing of the home study with the petition for adoption. Typically, we, at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), file what we call a “Dear Judge Letter” with the petition for adoption. As the name suggests, the letter begins “Dear Judge.” The adoption agency that completes the home study provides us a letter verifying that the adoption agency has approved the prospective adoptive parents for an adoptive placement and will supervise the placement and submit a report in accordance with Indiana Code §31-19-8.
