“Giving away” suggests that you are discarding, of getting rid of, your baby, as you might with an old pair of sneakers. A birth mother who has the courage, strength, and fortitude to entrust the life of her precious child to another set of parents is NOT one who has GIVEN AWAY her child. No, you don’t. At times, a birth mother will contact a national adoption agency or local adoption agency because the adoption agency has an eye-catching website, or a friend used that agency, or because the agency has told the birth mother not to work with an adoption attorney, probably because of competitive jealousy. Honestly, we, at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”) don’t know. Sometimes children hate their parents for all kinds of “reasons,” both imagined and real. Much of how an adoptee feels about adoption depends on what the adoptive parents say to the adoptee about adoption. An adopted person who grows up in a supportive, loving home, whose adoptive parents recognize and honor the sacrificial love of the birth mother in making an adoption plan will likely NOT have bad feelings about his or her birth parents. However, some children raised by their biological parents hate their parents. As the father of 3 boys and having been married for more than 45 years, I often recall what my father’s words: “Steve, don’t worry; it is just the first 20 years that are the hardest.”  I remember him telling me that when my boys were toddlers and going through the terrible twos.  As a parent of children who are now between the ages of 38 and 43, I realized that although my dad was trying to be funny, the first twenty years are really not the hardest.  As children get older, they face bigger problems.  As newborns, our biggest challenge was getting up in the middle of the night to change a dirty diaper, feed a hungry baby, or comfort a crying child.  “Monster Repellant Spray” (a.k.a. Lysol) worked wonders keeping the night monsters at bay when the boys were little, and it was bedtime. As they got older, their problems grew in complexity.  Even as a father of a forty-three old son, I still find myself giving lots of (often unsolicited) advice.

So what does this have to do with parenting a pregnant, teenage daughter?  The point is that parenting does not mean that you have to submit to your child’s wishes.  Parenting means that you assume responsibility and guide your children to the decision that is best for them.

Therefore, my advice to a parent of a teenage daughter, who is pregnant, is don’t stop being a parent because they happen to be pregnant.  With teenagers, you often have to convince them that it was their idea to take action, and, sometimes, a subtle approach is better than a more direct one. But if your first attempt at convincing them does not work, you must continue to try.

A pregnant teen faces the most difficult decision of her life and cannot possibly comprehend the commitment it takes to parent a child. And even though they may think they know everything as a teenager, they don’t.  That is where parenting comes in.

There is a balance because Indiana law does not allow a person to give a coerced consent to adoption.  And, in fact, a consent to adoption that is coerced would not be valid.  However, as a parent, you have the responsibility to guide and protect your child even if your child does not agree. Parenting is not about consensus building or winning popularity contests. Parenting is about raising your child to help them achieve their full potential.

Many states, including Indiana, allow adoptive parents to assist with expectant and birth mother living expenses to make her life easier but not act as an inducement for a birth parent to put up a baby for adoption or, more correctly, make an adoption plan for a baby. Living expenses include such things as housing, utilities, phone service, maternity clothing, travel, and other miscellaneous expenses related to the second and third trimester of the pregnancy and for up to 6 weeks following the birth of the baby, IN ADDITION TO medical, counseling, and legal fees.

We, at Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), have expectant and birth mothers complete a simple, one-page worksheet to verify their monthly expenses and then send the moms a check each month based upon their needs and the statutorily allowable expenses.

We DO NOT require expectant and birth mothers to sign a promissory note or contract, requiring the moms to repay living expenses in the event they decide not to proceed with an adoption. Furthermore, so long as a woman intends, in good faith, to proceed with an adoption, Indiana Law does not impose criminal penalties for accepting living expenses and not placing the baby for adoption.

As the expression goes, “Information is Power.” GET MORE INFORMATION about adoption from a compassionate, kind, experienced, adoption professional. In our 90 years of combined, legal, experience arranging adoptions, we, at Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”) have identified the two most common reasons that make expectant mothers uncertain about giving a baby up for adoption, or more correctly, making an adoption plan for their children: Firstly, the obvious reason – adoption is an IMPOSSIBLY DIFFICULT DECISION and, secondly, they don’t have enough information, or worse, have the wrong information. Getting correct information WITHOUT FEELING PRESSURED, will NOT make adoption an easy decision, but it will enable you to decide based on fact, not fiction. Here is an example. Let’s say you needed to get a COVID vaccination, but a well-meaning, BUT UNINFORMED, close friend told you that after the nurse gave you the shot, she would cut off your arm. As much as you might have thought getting the vaccine was a good idea, you would probably not get the shot, if it meant having your arm amputated. There may be valid reasons not to get a COVID vaccination, but fear that you will have your arm cut off is not one of them. Likewise, many birth mothers have very good reasons, not to give up a baby for adoption, but not everything well-meaning friends have told you might be true.
