It depends on the following 3 facts:

  1. The laws of the state in which the adoption is filed. 
  2. Whether the husband is the biological father of the child.
  3. The sufficiency of the proof that he is NOT the biological father. 

Because we at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”) operate out of Indiana, we have the option of filing adoptions in Indiana and following Indiana law, if either the prospective adoptive parents reside in Indiana, or the birth mother gives birth in Indiana. Indiana law does not require a husband’s consent to an adoption unless he is the biological or adoptive father of the child. Examples of sufficient evidence include incarceration of the husband when conception occurred or DNA proof that another man is the biological father. However, even if the husband is not the biological father of the child, Indiana law requires that he be given notice of the adoption, but he cannot successfully prevent the adoption from happening.
