Probably what a national adoption agency or local adoption agency told you is that they represent everyone in the adoption triad – the birth mother, child, and the adoptive parents.

As the Old and New Testaments provide, in a few different ways: no one can serve two masters. While it is a nice thought — representing the interests of both adoptive and birth parents — in practice, it only works if their interests remain perfectly aligned, which means that the prospective adoptive parents intend on adopting and the birth parents intend on giving up their baby for adoption, or more correctly, making an adoption plan for the baby. If either party decides not to proceed, it is hard for an adoption agency to remain neutral. It becomes even more difficult after the birth and adoptive placement of the child. If either side backs out and the agency takes one side or the other, the “losing” side will likely feel that the adoption agency is not looking after their interests. Adoption agencies often respond that their primary responsibility is to the best interests of the child. Again, the “losing” side will, doubtlessly, believe that they seek to do what is in the child’s best interests, and claim that the other side only thinks about their own selfish interests. Understand that this could not only happen if the birth parents decide to parent, but it could also happen if the prospective adoptive parents decide they do not want to adopt – think “sick” baby, as an example.

We, at Kirsh & Kirsh, make it clear to the expectant mothers and birth mothers who contact us asking for our assistance in finding an adoptive home for their newborn or soon-to-be-born or even older child that we represent the legal interests of the adoptive parents. We arrange for expectant and birth mothers to have their own attorneys, at no cost to them. Much of how an adoptee feels about adoption depends on what the adoptive parents say to the adoptee about adoption. An adopted person who grows up in a supportive, loving home, whose adoptive parents recognize and honor the sacrificial love of the birth mother in making an adoption plan will likely NOT have bad feelings about his or her birth parents. However, some children raised by their biological parents hate their parents. Our feelings about our parents largely depend on the love and affection of the parents and the life our parents have provided us.

We, at Kirsh & Kirsh, require that the adoptive parents whom we represent complete a homestudy by an independent, adoption agency. As part of the homestudy process, any reputable national adoption agency or local adoption agency will mandate adoption education as part of the homestudy process, including how birth parents LOVE their children, and, because of that love, they make the hardest decision imaginable by proceeding with an adoption.  Additionally, the adoptive parents represented by Kirsh & Kirsh desperately want to adopt. In our experience, adoptive parents have faced too many hurdles in having children to ever take their children for granted and are fully committed to being the best parents they can possibly be and providing their children a world of opportunities that will allow their child to reach his or her full potential in a loving, supportive, happy home.
