If you want to visit your child after you put my baby up for adoption or, more correctly, make an adoption plan for your baby, ask yourself this question: Do I want to see the child because I want to be a part of the child’s life or do I just want to see for myself that my child is okay?

If to remain a part of the child’s life, you should reconsider whether adoption is in the best interests of your child and your own best interests. If you proceed with an adoption, it is highly unlikely that you will have a meaningful enough relationship with the child to satisfy your need to remain a part of the child’s life, and you should be cautious of a national adoption agency, local adoption agency, or adoption facilitator who makes that promise to you. I PLAN TO PUT MY BABY UP FOR ADOPTION BUT DO NOT WANT THE BABY TO GO INTO THE FOSTER CARE SYSTEM

There are two ways can assure yourself that your baby will not go into foster care. Make sure the Department of Child Services in Indiana or a similar agency in your home state does not intervene in the adoption. Even if you have had other run-ins with DCS or used drugs during your pregnancy, if you make arrangements to give up your baby for adoption, or more correctly, make an adoption plan for your baby either within the first few hours after giving birth or before you deliver, you can probably avoid DCS involvement, which always involves foster care. WILL I GET INTO TROUBLE IF I TAKE LIVING EXPENSE MONEY FROM THE ADOPTIVE PARENTS AND DON’T PUT UP MY BABY FOR ADOPTION?

Each state has its own criminal statutes and definitions of what constitutes fraud. At the very least, it not right to take money from prospective adoptive parents without intending to give up the baby for adoption, or more correctly, make an adoption plan for the baby. Some states like Indiana, make it a FELONY for a woman pretending to be a birth mother or a birth mother to accept living expenses if she does not intend to make an adoptive placement or is not pregnant. See Indiana Code § 35-46-1-9.5. Besides possible jail time under the criminal statute, the defrauded adoptive parents can sue her for THREE TIMES the amount of money she took PLUS attorney fees under Indiana Code § 34-24-3-1.5.

On the other hand, if a woman sincerely intends to give up her baby for adoption and has an honest change of heart, she will not be in trouble.

WHAT IS INDIANA’S NEW ABORTION LAW, AND WHEN DOES IT GO INTO EFFECT?

Effective September 15, 2022, Indiana Code 16-34-2-1, will ban abortion in Indiana, except during the first 20 weeks of pregnancy to prevent “any serious health risk to the pregnant woman or save the pregnant woman’s life” or if “the fetus is diagnosed with a lethal fetal anomaly.” Also, a woman who got pregnant as a result of rape or incest may have an abortion during first 10 weeks of the pregnancy. Additionally, Indiana’s new abortion law limits the use of the abortion inducing drug, Mifepristone, to the first 8 weeks of the pregnancy. Some have described Indiana’s abortion law as the most restrictive abortion law in the country and the first since the Dobbs decision, which overturned Roe vs. Wade.

Putting a baby up for adoption, or more appropriately making an adoption plan, gives a woman facing an untimely pregnancy, unplanned pregnancy, or unwanted pregnancy an alternative to parenting the child.

DO I HAVE TO INVOLVE THE FATHER OF THE BABY IF I AM THINKING ABOUT PUTTING MY BABY UP FOR ADOPTION?

The answer depends on the state in which you live and whether you and the father of the baby are married or have been married to each other in roughly the year preceding the birth of the baby.  Because we, at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), have our main office in Indiana, we can file most of the adoptions we facilitate in Indiana, even if the birth mother or expectant mother lives in Mississippi, Tennessee, Kentucky, Michigan, or any other state. Indiana has among the best adoption laws in the country. Under Indiana law, an expectant or birth mother does NOT have to identify the father of the child. Indiana law enables a birth father to take the initiative to protect his parental rights if he so desires, by means of the Indiana Putative Father Registry. In 2020, the Indiana General Assembly enacted a bill that extended the concept of the Indiana Putative Father Registry to any state that has its own Putative Father Registry. If a woman conceives a child in any of the twenty-seven states with Putative Father Registries, we, at Kirsh & Kirsh, can file the adoption in Indiana and rely on the Putative Father Registry in the state of in which the woman got pregnant to address the birth father’s parental rights, without the birth mother having to identify him. However, under Indiana law, the Putative Father Registry does not apply to those men who have established paternity by in a court action or by executing a paternity affidavit or to husbands of birth mothers.

HOW DOES THE “GIFT OF ADOPTION” APPLY TO ME IF I AM A BIRTH PARENT THINKING ABOUT PUTTING MY BABY UP FOR ADOPTION?

Some birth parents think of giving prospective adoptive parents the gift of a child as the meaning of the “Gift of Adoption.” Of course, giving an adoptive family a baby is absolutely an AMAZING gift, as close to GOD-LIKE as any gift imaginable. In fact, one would be hard-pressed to think of a more unselfish, generous gift one person can give to another, but it only describes part of the magnitude of the gift. Another perspective is that the child receives the gift of a loving, secure, stable home with the chance to experience all that life offers, including good education and the opportunity to develop and explore his or her natural talents and interests. Furthermore, do not diminish the gift a birth parent gives herself or himself, knowing that their child is being cared for and loved by people who cannot wait to share their blessings with a child. It is okay for a birth parent, not ready or able to parent a child, to feel a sense of relief that they have secured a wonderful, loving home in which many, if not most, of their child’s wants and needs, will be satisfied.
