  1. “Meet” you in any way you want – in person, text, email, Zoom, telephone. 
  2. Tell you about thoroughly investigated and carefully screened prospective adoptive parents or select the adoptive family for you, if you want.
  3. NOT require endless meetings talking about your life.
  4. Answer your questions without judging you so you make the decision YOU think is best for you and YOUR BABY.
  5. NOT require counselling but encourage it and will make a counselor available to you at no cost. 
  6. Recommend, but not require, that you speak with your own attorney, again at no cost to you.
  7. Make all the arrangements for the adoption.
  8. NOT pressure you to give your baby up for adoption. That decision is hard enough.
  9. NOT charge you anything no matter what decision you make. 
  10. Help with your living expenses, allowed by law.

Receiving living expenses and getting money for the baby are NOT the same. Neither Indiana nor any other state allows adoptive parents to give a birth mother money for the baby. In fact, doing so would constitute the crime of “baby selling” in many states. As an example, Indiana Code § 35-46-1-9 makes it a felony to receive or pay moneyfor the baby. However, like many states, Indiana allows adoptive parents to give a birth mother or an expectant mother living expenses to help her with her pregnancy-related expenses during her pregnancy and for the postpartum period.

Many states, including Indiana, allow adoptive parents to assist with expectant and birth mother living expenses to make her life easier but not act as an inducement for a birth parent to put up a baby for adoption or, more correctly, make an adoption plan for a baby. Living expenses include such things as housing, utilities, phone service, maternity clothing, travel, and other miscellaneous expenses related to the second and third trimester of the pregnancy and for up to 6 weeks following the birth of the baby, IN ADDITION TO medical, counseling, and legal fees.

We, at Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), have expectant and birth mothers complete a simple, one-page worksheet to verify their monthly expenses and then send the moms a check each month based upon their needs and the statutorily allowable expenses.

We DO NOT require expectant and birth mothers to sign a promissory note or contract, requiring the moms to repay living expenses in the event they decide not to proceed with an adoption. Furthermore, so long as a woman intends, in good faith, to proceed with an adoption, Indiana Law does not impose criminal penalties for accepting living expenses and not placing the baby for adoption.
