If you contact an Indiana-based adoption law firm like Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), whether you live in Indiana or outside of Indiana, you can take advantage of Indiana law which provides birth mothers options for fathers who will not respond to their text messages or calls. One such law is “Pre-birth Notice.” Basically, if an adoption agency or adoption attorney can arrange for the named, birth father to “actually” receive the notice (in other words, put it in his hand) prior to the birth of the baby and the father does not respond to the notice within 30 days of his receipt of it, further notice of the adoption and the father’s consent to the adoption are not needed. Very importantly, this can be done BEFORE the baby’s birth, does NOT require him to sign ANYTHING, and does not require the birth mother to give up her baby for adoption, or, more correctly, make an adoption plan, if he does not respond. The “Pre-birth Notice” Statute has proven useful in dealing with uncooperative alleged fathers. By the way, the statute does NOT require the mother to know for sure that the man to whom the notice is given really is the father. Therefore, if it is possible that more than one man could be the father of the baby, the notice can be given to each of them.
