NO — ABSOLUTEY, NOT!!! You do not have to move to another state, should NOT do so, and should be very leery of a national adoption agency or local adoption agency that asks you to move for these reasons:

  1. Adoptions between states are common and easy to accomplish for competent and ethical adoption agencies and other adoption professionals that DO NOT require the birth mother to move out of her state of residence.
  2. If an adoption agency or adoption attorney wants you to move to another state, alarm bells should go off in your head. You should be very suspicious of their intentions and whether they can be trusted.
  3. If you move from your home to another state, you become completely dependent on the prospective adoptive parents and/or the adoption agency. What if you decide not to give up your baby for adoption, or more correctly, make an adoption plan – will they still pay your expenses to return home? What if you have a C-section and need more time to recover — will they pay for your expenses during your extended recovery period?

POSITIVE ADOPTION LANGUAGE DISCLAIMER: Please understand that these blog posts are written in a way to use language that people use when searching for help with their adoption plans. Unfortunately, while all of us understand what positive adoption language means, most expectant moms that come to us at first do not understand what that means. The most common search term on the Internet for expectant moms is “how do I give up my baby for adoption”. If we do not include those words in our blog posts, and instead put “how do I create an adoption plan for my baby” then our website will not show up in most expectant mom’s search results in Google.

If you give up your baby for adoption with one of the adoptive families represented by Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), you will NOT have the responsibility for paying for any of the medical costs associated with the birth of the child or your prenatal, delivery, or postpartum medical expenses related to the birth, even if you have a high deductible medical insurance policy. Kirsh & Kirsh will do two things to provide you protection from responsibility for those charges:

  1. We have a staff member who will act as an Authorized Medicaid Representative to see if you qualify for pregnancy Medicaid to cover the uninsured medical expenses. This will require very little effort on your part and has the ADDED ADVANTAGE TO YOU of assuring that the uninsured medical expenses will get paid IF YOU DECIDE TO PARENT THE BABY.
  2. If you do not qualify for pregnancy Medicaid, we will see that our clients, the adoptive parents, cover those expenses.

While this should be true of any local adoption agency, national adoption agencies, and adoptive parents, you cannot be certain. Kirsh & Kirsh will see that you do not have any financial responsibility for those charges after the consent to adoption is signed for one of the adoptive families represented by Kirsh & Kirsh to adopt.

We, at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), responded to a similar question about high-deductible, private insurance and stated that if an expectant mother or birth mother comes to us to put up her baby for adoption, or more correctly, make an adoption plan for the baby, we will see that her uninsured medical expenses get paid, without her having to pay them. Likewise, we will see that the baby’s medical expenses get paid. In fact, federal law requires most health insurance companies of adoptive parents to provide medical insurance coverage for an adopted child on the same basis as a child born into the family. While we cannot speak to how all local adoption agencies, national adoption agencies, or adoptive parents represented by law firms other than Kirsh & Kirsh, we, at Kirsh & Kirsh try to make the adoption process as easy as possible. We know that nothing will make putting a baby up for adoption easy, but we can make it easier by removing as many of the stressors as possible, including the financial ones.
