I DID NOT PLAN TO GET PREGNANT. CAN I GET AN ABORTION IN INDIANA?

The short answer is that the Indiana Supreme Court has put on hold the new law in Indiana, which was to have gone into effect on September 15, 2022. In other words, Indiana allows abortion to the same extent as prior to the enactment of the new abortion law. After it hears oral arguments in the case on January 19, 2023, the Indiana Supreme Court will decide whether to allow the new law to go into effect. If the Indiana Supreme Court strikes down Indiana’s new, abortion law, it will likely give reasons, which will provide direction for the Indiana General Assembly to modify the new law to satisfy the concerns of the court.

Among other changes, the new law limits the circumstances and time frame for a woman to have an abortion and the type of facility which can administer an abortion. Specifically, under the new law abortion clinics may no longer perform abortions.

I AM NOT READY TO PARENT MY BABY AND BELIEVE I SHOULD PUT THE BABY UP FOR ADOPTION, BUT THE BABY DADDY WILL NOT RESPOND TO ME. WHAT CAN I DO?

Very importantly, this can be done BEFORE the baby’s birth, does NOT require him to sign ANYTHING, and does not require the birth mother to give up her baby for adoption, or, more correctly, make an adoption plan, if he does not respond. The “Pre-birth Notice” Statute has proven useful in dealing with uncooperative alleged fathers. By the way, the statute does NOT require the mother to know for sure that the man to whom the notice is given really is the father. Therefore, if it is possible that more than one man could be the father of the baby, the notice can be given to each of them.

WILL I GET INTO TROUBLE IF I TAKE LIVING EXPENSE MONEY FROM THE ADOPTIVE PARENTS AND DON’T PUT UP MY BABY FOR ADOPTION?

Each state has its own criminal statutes and definitions of what constitutes fraud. At the very least, it not right to take money from prospective adoptive parents without intending to give up the baby for adoption, or more correctly, make an adoption plan for the baby. Some states like Indiana, make it a FELONY for a woman pretending to be a birth mother or a birth mother to accept living expenses if she does not intend to make an adoptive placement or is not pregnant. See Indiana Code § 35-46-1-9.5. Besides possible jail time under the criminal statute, the defrauded adoptive parents can sue her for THREE TIMES the amount of money she took PLUS attorney fees under Indiana Code § 34-24-3-1.5.

On the other hand, if a woman sincerely intends to give up her baby for adoption and has an honest change of heart, she will not be in trouble.

WHAT CONSTITUTES RAPE OR INCEST FOR THE PURPOSE OF INDIANA’S NEW ABORTION LAW?

Indiana Code § 16-34-2-1 permits a woman to abort a baby during the first 10 weeks of her pregnancy if she got pregnant as a result of rape or incest. While Indiana’s new abortion law does not require a conviction or even a reporting of the rape or incest by the pregnant woman, Indiana Code § 16-18-2-306.7 expands the definition of “rape or incest” to include a child conceived as a result of child molesting (IC § 35-42-4-3), child seduction (IC § 35-42-4-7), and sexual misconduct with a minor (IC § 35-42-4-9).

However, other provisions of Indiana Law such as IC §§ 31-32-11-1 and 31-33-5-1 may impose on the doctor the obligation to report to the department of child services or local law enforcement agency suspected child abuse or neglect. Incest, child molestation, child seduction, and sexual misconduct with a minor may fall into the category of reportable offenses.

Additionally, IC § 16-34-2-1 (a)(2)(D) requires the doctor to certify in writing to the surgical center or hospital all facts and reasons supporting the physician’s certification, which presumably includes facts about the rape or incest.

Finally, a doctor who performs an abortion without complying with IC § 16-34-2-1 commits a criminal act, which could subject the doctor to criminal and civil penalties and forfeiture of their license to practice medicine. The reporting requirements imposed on the physician under § 16-34-2-5 seem designed to substantiate how abortion fits within the exceptions of the total abortion ban imposed by Indiana law.

WHAT IS INDIANA’S NEW ABORTION LAW, AND WHEN DOES IT GO INTO EFFECT?

Effective September 15, 2022, Indiana Code 16-34-2-1, will ban abortion in Indiana, except during the first 20 weeks of pregnancy to prevent “any serious health risk to the pregnant woman or save the pregnant woman’s life” or if “the fetus is diagnosed with a lethal fetal anomaly.” Also, a woman who got pregnant as a result of rape or incest may have an abortion during first 10 weeks of the pregnancy. Additionally, Indiana’s new abortion law limits the use of the abortion inducing drug, Mifepristone, to the first 8 weeks of the pregnancy. Some have described Indiana’s abortion law as the most restrictive abortion law in the country and the first since the Dobbs decision, which overturned Roe vs. Wade.

Putting a baby up for adoption, or more appropriately making an adoption plan, gives a woman facing an untimely pregnancy, unplanned pregnancy, or unwanted pregnancy an alternative to parenting the child.

WOULD A WOMAN CONSIDERING ABORTION NATURALLY CHOOSE ADOPTION?

NO! Adoption is not an alternative to abortion: it is an alternative to parenting when a birth mother is not ready to take on the lifetime commitment of raising a child. Some women get very upset at the notion that a woman who would consider abortion would naturally choose adoption. However, perhaps those women should, at least, give adoption a second thought. Certainly, if a woman considers having an abortion, she must question her desire or ability, or both, to parent the child. Adoption is an alternative to personally parenting a child. Adoption allows the child the opportunity to live life and reach her or his full potential, the birth parents to know that their child is safe and secure, and the adoptive parents to realize their dreams of parenthood. I DID NOT WANT TO BE PREGNANT. WHAT CAN I DO IF I CAN’T GET AN ABORTION?

Let’s start with two obvious facts: (1) You cannot undo the fact that you ARE pregnant, and (2) you will give birth to a baby. None of us can change the past. What has happened has already happened — as the expression goes, “You can’t unring the bell.” You need to change your focus to how to make the best of what you consider a bad situation, if you are not happy about being pregnant. Most importantly, you are now responsible for the life of an innocent child, and you need to make the best decision for him or her.

For most women facing an untimely pregnancy or unplanned pregnancy, they intentionally or unintentionally (by not making other plans) decide to parent the child. In most situations that decision works out well for the mother and child. For those successfully parenting women, who did not plan to get pregnant, they take on the challenge of parenting a child for the rest of their lives and do it well.

However, not everyone has the desire, skill, and resources to dedicate their lives to the responsibility of raising a child. For those women, they need to look for other alternatives. Some will find that their parents will happily, or out of a sense of obligation to a grandchild, take on the responsibility parenting the child.

Another alternative, which does not get nearly enough attention, is to put the baby up for adoption, or, more correctly, to make an adoption plan for the child. Nothing will change the fact of the pregnancy, but giving newborn the gift of a loving, secure, happy home and adoptive parents, desperate for a child, the gift of parenthood may just be the best way to turn a bad, even hopeless, situation into the best outcome for all involved, including the birth mother. Not often can any of us change the lives of others in a meaningful way. To give a child the opportunity for a productive happy life and adoptive parents a child to nurture and love is a close to God-like as anything one human can do for another.

The most common search term on the Internet for expectant moms is “how do I give up my baby for adoption.” If we do not include those words in our blog posts, and instead put “how do I create an adoption plan for my baby,” then our website will not show up in most expectant moms’ search results on Google.
