“Open adoption” does not have a set, universally understood definition. It is best to think of openness in in an adoption as a spectrum – at one end of the spectrum, adoptions are completely closed or confidential, meaning the exchange of no information. Neither the adoptive parents nor birth parents know ANYTHING AT ALL about the other. At the other end of the spectrum is a completely open arrangement in which the parties plan to raise the adoptee together, also called “Cooperative Parenting,” and know EVERYTHING about each other. In our vast experience of having arranged adoptions for nearly 40 years, we at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”) have not seen ANY adoptions at either end of the spectrum. All adoptions which we have facilitated fall somewhere between the ends of the spectrum. Because we do NOT follow the “one size fits all” approach, we tailor each adoption to the desires and needs of the parties involved in that adoption. In most cases, we, at Adoption Attorneys Kirsh & Kirsh, file all adoptions in Indiana because Indiana has very favorable adoption laws. To file an adoption in Indiana, we need an Indiana connection to the adoption – the adoptive parents or birth mother need to live in Indiana.  Among other benefits to birth mothers, Indiana adoption law allows a birth mother to sign her consent to adoption any time after the birth of the child, does NOT require the birth parents to physically go to court to give their consents to the adoption, and a birth mother does NOT have to identify the father of the child. It is safe to say that no parent wants their child to hate them. Unfortunately, as any parent of a teenager will tell you, some children (particularly during their teenaged years) hate their parents for all kinds of reasons, real and imagined. No matter what decision a parent makes when it comes to parenting their child, there is no guarantee that the child will not disagree with the parent’s action. Parents should not make decisions for their children based upon a hope that their children will like or approve of the decisions. Parents need to make decisions based upon what the parent believes serves the child’s best interests.
