The short answer is that the Indiana Supreme Court has put on hold the new law in Indiana, which was to have gone into effect on September 15, 2022. In other words, Indiana allows abortion to the same extent as prior to the enactment of the new abortion law. After it hears oral arguments in the case on January 19, 2023, the Indiana Supreme Court will decide whether to allow the new law to go into effect. If the Indiana Supreme Court strikes down Indiana’s new, abortion law, it will likely give reasons, which will provide direction for the Indiana General Assembly to modify the new law to satisfy the concerns of the court.

Among other changes, the new law limits the circumstances and time frame for a woman to have an abortion and the type of facility which can administer an abortion. Specifically, under the new law abortion clinics may no longer perform abortions.

Regardless of what happens to Indiana’s abortion law, if you face an unplanned pregnancy or an untimely pregnancy, you should explore giving your baby up for adoption, or more correctly, making an adoption plan for your unborn child.

POSITIVE ADOPTION LANGUAGE DISCLAIMER:  Please understand that these blog posts are written in a way to use language that people use when searching for help with their adoption plans.  Unfortunately, while all of us understand what positive adoption language means, most expectant moms that come to us at first do not understand what that means. The most common search term on the Internet for expectant moms is “how do I give up my baby for adoption”.  If we do not include those words in our blog posts, and instead put “how do I create an adoption plan for my baby” then our website will not show up in most expectant mom’s search results in Google.

If you contact an Indiana-based adoption law firm like Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), whether you live in Indiana or outside of Indiana, you can take advantage of Indiana law which provides birth mothers options for fathers who will not respond to their text messages or calls. One such law is “Pre-birth Notice.” Basically, if an adoption agency or adoption attorney can arrange for the named, birth father to “actually” receive the notice (in other words, put it in his hand) prior to the birth of the baby and the father does not respond to the notice within 30 days of his receipt of it, further notice of the adoption and the father’s consent to the adoption are not needed. Very importantly, this can be done BEFORE the baby’s birth, does NOT require him to sign ANYTHING, and does not require the birth mother to give up her baby for adoption, or, more correctly, make an adoption plan, if he does not respond. The “Pre-birth Notice” Statute has proven useful in dealing with uncooperative alleged fathers. By the way, the statute does NOT require the mother to know for sure that the man to whom the notice is given really is the father. Therefore, if it is possible that more than one man could be the father of the baby, the notice can be given to each of them.

If you would like more information about Pre-birth Notice, your other options regarding the father of the baby, or would like to explore adoption, we, at Kirsh & Kirsh — or the “Kirsh Boys,” as the adoption attorneys at Kirsh & Kirsh are sometimes called – Steve, and his brothers, Joel and Rob, and his son, Grant, pride themselves on answering questions about adoption and explaining the process without pressure or judgment.

If you think adoption and a baby box are your best alternatives, then you obviously want what is best for your baby. While a baby box assures the safety of your baby, it may not be the best choice for your baby or you. Consider the following:

  1. Starting with what seems most important to you – TIME. If you work with us at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), we can arrange for the adoption of your baby the same day you contact us. Our attorneys have over 90 years of combined legal experience handling adoptions; we have many, carefully screened, fully investigated, loving families, who are ready to take in a child on a moment’s notice; and we will handle everything compassionately, efficiently, and as quickly as you want, without you feeling pressured or hurried. At the very least, call us and see what we can do to help you. Our contact information is below. A member of our full-time, adoption team – NOT AN ANSWERING SERVICE – will answer your call 24/7/365.
  2. Without question, if you put your baby in a baby box, the baby will go directly into the foster care system rather than a forever home.
  3. Putting your baby up for adoption, or more correctly, making an adoption plan for your baby, enables you the option of selecting the adoptive parents or parent for your baby if you work with an adoption law firm, like Kirsh & Kirsh, a national adoption agency, or a local adoption agency.
  4. While it might not now be important to you to receive updates about your child, you may want that in the future. At Kirsh & Kirsh, we have all of our clients create updates and store them in the Cloud for our birth mothers, because in our years of experience handling adoptions, we know that many times birth mothers change their minds about receiving updates. If you use a baby box, you have no chance of ever getting updates.
  5. For some women, taking a little extra time to do an adoption lets them feel like they actually planned their baby’s future rather than abandoning their baby. Of course, using a baby box assures the safety of their baby, but the extra time to do an adoption may provide a greater sense of peace in your decision.
