It depends on the following 3 facts:

  1. The laws of the state in which the adoption is filed.
  2. Whether the husband is the biological father of the child.
  3. The sufficiency of the proof that he is NOT the biological father.

Because we at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”) operate out of Indiana, we have the option of filing adoptions in Indiana and following Indiana law, if either the prospective adoptive parents reside in Indiana, or the birth mother gives birth in Indiana. Indiana law does not require a husband’s consent to an adoption unless he is the biological or adoptive father of the child. Examples of sufficient evidence include incarceration of the husband when conception occurred or DNA proof that another man is the biological father. However, even if the husband is not the biological father of the child, Indiana law requires that he be given notice of the adoption, but he cannot successfully prevent the adoption from happening.

POSITIVE ADOPTION LANGUAGE DISCLAIMER:  Please understand that these blog posts are written in a way to use language that people use when searching for help with their adoption plans.  Unfortunately, while all of us understand what positive adoption language means, most expectant moms that come to us at first do not understand what that means. The most common search term on the Internet for expectant moms is “how do I give up my baby for adoption”.  If we do not include those words in our blog posts, and instead put “how do I create an adoption plan for my baby” then our website will not show up in most expectant mom’s search results in Google.

We, at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”) do not limit ourselves to what local adoption agencies, national adoption agencies, and other businesses might consider “regular office hours.” We will talk or meet with you to explain adoption and answer your questions at whatever time and place works best for you. This becomes especially important for those birth mothers who decide to proceed with giving their babies up for adoption, or more correctly, making an adoption plan, after they give birth. Babies do not know much about “regular business hours”! While we will not rush into the hospital immediately after you give birth, we will come to the hospital whenever the you are ready to see us, even on weekends and holidays. Furthermore, a member of our regular office staff answers our phones 24/7/365. You will not receive voicemail or off-site answering service. The same people who answer our phones during “regular business hours” answer during weekends, evenings, and holidays.

Hey there!

Have you ever wondered what adoption is all about? It’s a really cool thing that helps kids find loving families. Let’s talk about what adoption is and how it helps kids like you find their forever homes.

What is Adoption?

Adoption is a special way for kids to become part of a family. Sometimes, kids need a new family to take care of them, and that’s where adoption comes in. It’s a way for these kids to find a new family who will love them, care for them, and be there for them every day.

Meeting a New Family

When a kid is adopted, they get to meet their new family. This new family becomes their forever family, and they’ll have a mom and dad who will take care of them. They might also have brothers, sisters, and pets to play with and have fun with.

Choosing a Family

Sometimes, the kid’s first family helps choose the new family for them. They want to make sure that the kid will be happy and loved in their new home. It’s a special way for everyone to make sure that the kid will have a great life with their new family.

Becoming a Forever Family

Adoption means that the new family will take care of the kid forever. They’ll give them a safe and happy home, yummy food to eat, and lots of love and cuddles. The kid becomes part of the new family and gets to share in all the fun and love.

A New Beginning

Adoption is like a new beginning for the kid. It’s a chance for them to have a happy and safe life with a family that will love them no matter what. It’s a way for kids to have great opportunities and be part of a loving family.

In Conclusion

Adoption is all about finding a loving family for kids who need one. It’s a big decision, but it’s made out of love and care for the kid. It’s okay to have questions about adoption.

Author’s Note: This blog is for young adults who want to understand what adoption is all about. It’s a special way for kids to find their forever families.
