CAN THE BIRTH FATHER’S PARENTS OR BIRTH MOTHER’S STOP THE ADOPTION, OR DO THEY HAVE GRANDPARENT VISITATION RIGHTS?

(“Kirsh & Kirsh”) try to file most of the adoptions they arrange in Indiana, so long as either the birth parents, adoptive parents, or child live in Indiana. Under Indiana law, neither the birth father’s nor birth mother’s parents – the child’s grandparents – have legal standing or grounds to object to an adoption. Additionally, in Indiana, grandparents have limited visitation rights which usually only come into play if the child’s parent is deceased. Also, those rights end with the adoption of the child by anyone other than a stepparent or a close family member, biologically related to the child, such as a grandparent, sibling, aunt, uncle, niece, or nephew.
