PUT UP MY BABY FOR ADOPTION

IF DECIDE TO PUT UP MY BABY FOR ADOPTION, HOW LONG AFTER I GIVE BIRTH DO I HAVE TO WAIT TO SIGN THE RELINQUISHMENT OF PARENTAL RIGHTS OR CONSENT TO ADOPTION?

The answer depends on the state in which you gave birth, or the adoption will take place. In most of the adoptions arranged by Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), we follow Indiana law even if the birth mother gives birth in another state. Under Indiana law, a birth mother may sign a consent to adoption any time AFTER she gives birth. Indiana law and the laws of most states do NOT allow an expectant mother to sign a consent to adoption before giving birth. We usually wait until the next day after she gives birth, but the timing of the consent signing is mostly up to the birth mother. “Mostly” because, we would not have a birth mother sign a consent within minutes of giving birth, even if she wanted to sign that soon. Likewise, we would never want the birth mother to feel pressured or rushed to sign the consent. We have found that the day after giving birth or longer, if the birth mother had a complicated delivery or C-section usually works for most birth mothers. Again, and very importantly, we will follow her lead. Sometimes if the birth mother gives birth in a state other than Indiana, even if we file the adoption in Indiana, the laws of the state of birth will make a woman wait a certain number of days or hours before she can sign adoption papers.

WILL MY CHILD HATE ME IF I PUT MY BABY UP FOR ADOPTION?

This question occupies the minds of many, if not all, birth parents who consider giving their newborns and older children up for adoption, or more correctly, making an adoption plan for their child/children. It would be hard not to have such a concern. However, while a parent may consider their child’s opinion about a decision, a parent MUST make decisions based upon what the parent believes serves the child’s best interests, even if the child believes otherwise. Effective parenting is not about garnering the child’s approval but doing what the PARENT believes best serves the child’s present and future well-being. This is especially true as the size of the decision increases. If a parent occasionally allows their child to stay up late rather than going to bed at a reasonable hour, deferring to the child may result in a cranky, tired child the next morning, but it will have little long-term impact on the child’s life. But always allowing a child to spend time playing video games instead of doing their homework will have big consequences for the child’s future. A birth mother who believes that an adoptive home gives her child the best chance to realize his or her full potential, as a productive member of society is UNQUESTIONABLY a course of action that a birth mother needs to make regardless of what the child may think of the decision at some future time. So, in direct answer to the question posed above –your child may not understand why you put the child up for adoption, but, as a parent you must do what YOU believe is best for the child. By the way, it is also quite possible that in the right adoptive home, where you as the birth mother are celebrated for the being the hero that you are, the child may very well come to love you for the decision.
