I DO NOT WANT TO ABORT THE BABY, BUT I AM PREGNANT AND NOT READY FOR A BABY. WHAT CAN I DO?

You are not alone. Millions of birth parents face this dilemma every year. You could ask a friend or family to help you raise the child or raise the child for you. You might find an adoption agency to take short-term foster care of the child. You could give birth and invoke the Safe Haven Law by leaving the baby at a police or fire station or hospital if the state in which you live has a Safe Haven Law. Alternatively, you could put up the baby for adoption, or more correctly, make an adoption plan for the child. Choosing to pursue Safe Haven protects the baby but puts it into the foster care system, whereas adoption does not.

If you find yourself with an unplanned pregnancy or untimely pregnancy (few women would use the phrase “unwanted pregnancy”), you should carefully research and consider your options. None of the ones listed nor any others you might find “undo” the pregnancy. Abortion will terminate the pregnancy but not erase it. All are very personal decisions. POSITIVE ADOPTION LANGUAGE DISCLAIMER: Please understand that these blog posts are written in a way to use language that people use when searching for help with their adoption plans. Unfortunately, while all of us understand what positive adoption language means, most expectant moms that come to us at first do not understand what that means. The most common search term on the Internet for expectant moms is “how do I give up my baby for adoption”. If we do not include those words in our blog posts, and instead put “how do I create an adoption plan for my baby” then our website will not show up in most expectant mom’s search results in Google.

CAN I RECEIVE HELP WITH MY EXPENSES IF I GIVE UP A BABY FOR ADOPTION?

Many states, including Indiana, allow adoptive parents to assist with expectant and birth mother living expenses to make her life easier but not act as an inducement for a birth parent to put up a baby for adoption or, more correctly, make an adoption plan for a baby. Living expenses include such things as housing, utilities, phone service, maternity clothing, travel, and other miscellaneous expenses related to the second and third trimester of the pregnancy and for up to 6 weeks following the birth of the baby, IN ADDITION TO medical, counseling, and legal fees.

We, at Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), have expectant and birth mothers complete a simple, one-page worksheet to verify their monthly expenses and then send the moms a check each month based upon their needs and the statutorily allowable expenses.

We DO NOT require expectant and birth mothers to sign a promissory note or contract, requiring the moms to repay living expenses in the event they decide not to proceed with an adoption. Furthermore, so long as a woman intends, in good faith, to proceed with an adoption, Indiana Law does not impose criminal penalties for accepting living expenses and not placing the baby for adoption.

IF I PUT MY BABY UP FOR ADOPTION, CAN I PICK THE ADOPTIVE FAMILY?

ABSOLUTELY, if you work with Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”). Years ago, pregnant women, with untimely pregnancies or unplanned pregnancies would go to adoption agencies to give up for adoption their babies, or more correctly, make adoption plans for their newborns. The agencies, using their own criteria, decided who would adopt a woman’s baby, with little or no input from her.
