Indiana Adoption Laws make adoption court records STRICTLY CONFIDENTIAL. Additionally, Indiana Adoption Laws do not require you to involve anyone in the adoption whom you do not want to involve. That includes the unwed father of the child. If you are married, you may still not have to involve your husband, if he is not the biological father of the child.

Steve Kirsh co-founded the firm in 1981 and began handling adoptions in the early 1980s. As the number of adoptions increased, Steve needed help, which is when Joel Kirsh, Steve’s brother got involved in facilitating adoptions. Steve served as president and treasurer of the American Academy of Adoption Attorneys, an internationally recognized association of adoption and ARTs attorneys; received an Angels in Adoption Award by the United States Congress; represented the United States as part of the US delegation to the final drafting session of the Hague Convention on Inter-country Adoption; has made significant contributions to amending Indiana’s adoption laws, which a number of states have copied because Indiana’s laws are among the best in the country. For his efforts, the Indiana General Assembly afforded Steve special recognition. Steve also authored the Adoption Protocol used by nearly all Indiana Hospitals.

A LOCAL ADOPTION AGENCY SAID THAT I SHOULD NOT WORK WITH ADOPTION ATTORNEYS KIRSH & KIRSH, P.C. (“KIRSH & KIRSH”) BECAUSE THEY REPRESENT THE ADOPTIVE PARENTS AND THE ADOPTION AGENCY REPRESENTS ME?

Probably what a national adoption agency or local adoption agency told you is that they represent everyone in the adoption triad – the birth mother, child, and the adoptive parents.

Kirsh & Kirsh is an adoption law firm, not an adoption agency. We do not claim to represent the legal interests of everyone. As the Old and New Testaments provide, in a few different ways: no one can serve two masters. While it is a nice thought — representing the interests of both adoptive and birth parents — in practice, it only works if their interests remain perfectly aligned, which means that the prospective adoptive parents intend on adopting and the birth parents intend on giving up their baby for adoption, or more correctly, making an adoption plan for the baby. If either party decides not to proceed, it is hard for an adoption agency to remain neutral. It becomes even more difficult after the birth and adoptive placement of the child. If either side backs out and the agency takes one side or the other, the “losing” side will likely feel that the adoption agency is not looking after their interests. Adoption agencies often respond that their primary responsibility is to the best interests of the child. Again, the “losing” side will, doubtlessly, believe that they seek to do what is in the child’s best interests, and claim that the other side only thinks about their own selfish interests. Understand that this could not only happen if the birth parents decide to parent, but it could also happen if the prospective adoptive parents decide they do not want to adopt – think “sick” baby, as an example.

We, at Kirsh & Kirsh, make it clear to the expectant mothers and birth mothers who contact us asking for our assistance in finding an adoptive home for their newborn or soon-to-be-born or even older child that we represent the legal interests of the adoptive parents. We arrange for expectant and birth mothers to have their own attorneys, at no cost to them. Even though we do not act as the attorney for the birth mother, we are her point of contact and make all of the arrangements for the adoption, including introducing her to prospective adoptive parents.
