NO — ABSOLUTEY, NOT!!! You do not have to move to another state, should NOT do so, and should be very leery of a national adoption agency or local adoption agency that asks you to move for these reasons:

  1. Adoptions between states are common and easy to accomplish for competent and ethical adoption agencies and other adoption professionals that DO NOT require the birth mother to move out of her state of residence.
  2. If an adoption agency or adoption attorney wants you to move to another state, alarm bells should go off in your head. You should be very suspicious of their intentions and whether they can be trusted.
  3. If you move from your home to another state, you become completely dependent on the prospective adoptive parents and/or the adoption agency. What if you decide not to give up your baby for adoption, or more correctly, make an adoption plan – will they still pay your expenses to return home? What if you have a C-section and need more time to recover — will they pay for your expenses during your extended recovery period?

POSITIVE ADOPTION LANGUAGE DISCLAIMER: Please understand that these blog posts are written in a way to use language that people use when searching for help with their adoption plans. Unfortunately, while all of us understand what positive adoption language means, most expectant moms that come to us at first do not understand what that means. The most common search term on the Internet for expectant moms is “how do I give up my baby for adoption”. If we do not include those words in our blog posts, and instead put “how do I create an adoption plan for my baby” then our website will not show up in most expectant mom’s search results in Google.

If you give up your baby for adoption with one of the adoptive families represented by Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), you will NOT have the responsibility for paying for any of the medical costs associated with the birth of the child or your prenatal, delivery, or postpartum medical expenses related to the birth, even if you have a high deductible medical insurance policy. Kirsh & Kirsh will do two things to provide you protection from responsibility for those charges:

  1. We have a staff member who will act as an Authorized Medicaid Representative to see if you qualify for pregnancy Medicaid to cover the uninsured medical expenses. This will require very little effort on your part and has the ADDED ADVANTAGE TO YOU of assuring that the uninsured medical expenses will get paid IF YOU DECIDE TO PARENT THE BABY.
  2. If you do not qualify for pregnancy Medicaid, we will see that our clients, the adoptive parents, cover those expenses.

While this should be true of any local adoption agency, national adoption agencies, and adoptive parents, you cannot be certain. Kirsh & Kirsh will see that you do not have any financial responsibility for those charges after the consent to adoption is signed for one of the adoptive families represented by Kirsh & Kirsh to adopt.

We, at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), responded to a similar question about high-deductible, private insurance and stated that if an expectant mother or birth mother comes to us to put up her baby for adoption, or more correctly, make an adoption plan for the baby, we will see that her uninsured medical expenses get paid, without her having to pay them. Likewise, we will see that the baby’s medical expenses get paid. In fact, federal law requires most health insurance companies of adoptive parents to provide medical insurance coverage for an adopted child on the same basis as a child born into the family. While we cannot speak to how all local adoption agencies, national adoption agencies, or adoptive parents represented by law firms other than Kirsh & Kirsh, we, at Kirsh & Kirsh try to make the adoption process as easy as possible. We know that nothing will make putting a baby up for adoption easy, but we can make it easier by removing as many of the stressors as possible, including the financial ones.

While likely not the first thing a birth mother contemplates putting her baby up for adoption or, more correctly, making an adoption plan, it is something to consider. Not many times in our lives do we get “do-overs.” We often find ourselves in a situation when we think to ourselves, “Next time I will know better or do it differently.” If you put up your baby for adoption through a local adoption agency, national adoption agency, or adoption professionals like Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”), you get the chance to change the trajectory of your life. Imagine the range of things you could do if you did not have the responsibility of caring for a baby until the child reaches adulthood – while knowing that you have given a family the most precious gift one human being can give another – a child. Also, knowing that you have given your child the gift of devoted, loving parents, who can give your child everything you would want for her or him.

That is a difficult question to answer, but if that is your biggest concern in deciding whether to put up your child for adoption, you probably should not do an adoption. Of course, children can find all kinds of reasons – some real and some imaginary — to hate their parents completely unrelated to an adoptive placement. As parents our job is to do our best to raise our children to enable them to reach their full potential as productive members of society. Therefore, maybe, the question you should ask yourself is “Can I do that for the children I presently have AND the child I am about to have if I do not give up the newborn for adoption?” Adoption professionals – adoption agencies and adoption attorneys — refer to it as making an “adoption plan,” because that is what a birth mother does, when she decides adoption gives her child (and children she will continue to parent) the best opportunities to lead successful lives.

When talking with children, it is important to provide age-appropriate information and be honest. Obviously, how you explain it to a 5-year-old will differ from what you tell a 15-year-old. For a 5-year-old, as an example, you may want to say something like: “Mommy had a very difficult decision to make and did what she believed was best for you and the baby,” and not go into any more detail.  For the 15-year-old, you may want to explain the reasons that went into your decision.

However, you need to keep in my mind two very important points, regardless of the age of your children:

  1. You are the parent and the one responsible for caring for your children. With all parental decisions, it is up to YOU to do what is best for your children, even if your children disagree with you.
  2. Seek input from your children, if you want, but you cannot allow children to rule the household, especially with a decision of this magnitude.

If you already have kids and cannot raise another one due to an untimely pregnancy, unplanned pregnancy, or unexpected pregnancy, you may want to consider putting your baby up for adoption or more correctly, making an adoption plan for the baby you are carrying. In certain circumstances, you may give up your baby for adoption without completing a background form, but consider these reasons for not only filling one out but doing so in as much detail as possible:

  1. If a birth mother has a special talent, interest or skill, and the adoptive parents know about it, they can help her child foster that talent, interest, or skill.
  2. Likewise, if the adoptive parents know that the birth parents have a particular medical condition or it runs in the birth families, the adoptive parents can look out for that condition and provide better medical care for the child.
  3. A birth mother who puts her newborn up for adoption or, more correctly, makes an adoption plan for the child, does so because she loves her child and wants more for her child than she feels that she can provide at that moment in her life. Filling out a detailed background form for the local adoption agency, national adoption agency, or other adoption professional is consistent with her motivations for pursuing adoption.
  4. Arguably, the most important reason relates to a concern that nearly every expectant mother and birth mother has when thinking about adoption for their newborns: What will my child think of me for having made the decision I made? The very act of completing a detailed background shows the child that his or her birth mother and birth father, if he is involved, made a conscious, intentional decision to put the child’s needs ahead of their own needs. Also, consider that a parent who abandons their child, or worse, does not take the time to leave for the child detailed background information.

We, at Adoption Attorneys Kirsh & Kirsh, P.C. (“Kirsh & Kirsh”) get asked this question often. We cannot answer for national adoption agencies nor local adoption agencies, but at Kirsh & Kirsh, we try to make the process as straightforward and simple as possible without unnecessary meetings and paperwork. While we will only arrange to place a newborn child up for adoption completely above-board and legally, we do not want to overly burden a birth mother or an expectant mother who already must deal with more than her fair share of stress.

In the simple terms, in choosing to work with us to give up your baby for adoption, or, more correctly, make an adoption plan for your newborn, you can expect the following:

  1. Meet us in person on the phone, over Zoom, or fill out your information electronically.
  2. Pick a family from profiles we will send to you, talk, text, or meet that family and decide if you want us to match with them with you. Or we will choose the family if you prefer.
  3. There are a few documents that we will ask you to complete and sign before the baby’s birth –none of which are a consent to adoption. You cannot sign a consent to adoption until after you give birth. In other words, you are not obligated to proceed with the adoption by doing the paperwork.
  4. You decide if you want to talk with a counselor and have your own attorney.
  5. After you give birth, you will decide if you want to proceed with the adoption. If so, we will arrange for you to sign the consent to adoption. If not, we will go our separate ways. We will never pressure you to proceed or criticize you if you decide to parent the baby. We want you to do whatever YOU believe is best for you and your baby.

The entire process costs you nothing, and you are not obligated to proceed with the adoption plan you have put together, unless and until you sign a consent to adoption, after you give birth.

If you would like more information about adoption and available living expenses during and after your pregnancy, we, at Adoption Attorneys Kirsh & Kirsh, P.C. — or the “Kirsh Boys,” as the adoption attorneys at Kirsh & Kirsh are sometimes called – Steve, and his brothers, Joel and Rob, and his son, Grant, pride themselves on answering questions about adoption and explaining the process without pressure or judgment.

Not only do the four adoption attorneys at Kirsh & Kirsh have over 100 years of combined legal experience arranging adoptions, Kirsh & Kirsh has been in existence since 1981.
